Website Terms of Use

These terms apply to your use of theparentwill.com.au (this website).

These terms do not govern our legal services. If we act for you, a separate costs agreement and costs disclosure statement will set out the terms of that engagement. See section 5.

1. Who we are

This website is operated by The Parent Will Pty Ltd (ACN 701 518 283, ABN 44 701 518 283), an incorporated legal practice in Queensland.

Our legal practitioner director, Jade Harmer, holds a practising certificate issued by the Queensland Law Society and is entitled to practise in Queensland. We provide legal services in Queensland only.

In these terms, “we”, “us” and “our” mean The Parent Will Pty Ltd.

Liability limited by a scheme approved under professional standards legislation.

2. Accepting these terms

By using this website (including browsing pages, reading our resources, submitting an enquiry or booking a consultation), you agree to these terms. If you do not agree, please do not use the site.

We may update these terms. The version published here when you use the site is the version that applies.

3. The information on this site is general only

Everything on this website, including service descriptions, articles, guides, checklists, FAQs and downloadable resources, is general information only. It is not legal advice and must not be relied on as legal advice.

Estate planning outcomes depend on your particular circumstances: your family structure, what you own and how you own it, superannuation and life insurance nominations, and business interests. General information cannot account for these.

The information on this site is based on Queensland law. It does not address the law of other Australian states or territories, or of other countries, and the law changes over time.

Legal advice is provided only after we have been engaged, have understood your circumstances, and have agreed the scope of work with you.

4. Using this website creates no lawyer-client relationship

Reading this website, downloading a resource, submitting an enquiry or booking a free consultation does not create a solicitor-client relationship and does not mean we act for you.

  • Information you send us before we are engaged may not be confidential or privileged. Please do not send us detailed or sensitive information about your circumstances until we have confirmed we can act for you.
  • We may be unable to act for you, including because of a conflict of interest. We check for conflicts before accepting an engagement.
  • We are not responsible for any deadline missed, or consequence of delay, before we are engaged.

5. Free consultations and becoming a client

Our free initial consultation is an opportunity for both of us to work out whether we are a good fit. It is not a legal advice session. We will not advise you on which documents you need, how your assets should pass, or the legal effect of any arrangement during it.

If we can help, our process is:

  1. Consultation or enquiry.
  2. Costs agreement and costs disclosure statement, setting out scope, the fixed fee, inclusions and exclusions, disbursements, and your rights in relation to costs.
  3. Your acceptance of that agreement.
  4. Onboarding, including detailed information, identity verification, conflict check.
  5. Work begins.

We do not act for you until step 3 is complete. The costs agreement, not this website or any pricing page, sets out the binding terms of our retainer. If anything on this website conflicts with your costs agreement, the costs agreement prevails.

You are entitled to negotiate the costs agreement, and to seek independent advice about it, before accepting.

We may decline an engagement for any reason.

6. Who we can act for

We provide services to individuals who are 18 or over, reside in Queensland, and have legal capacity to give instructions and execute estate planning documents.

We are a fixed-fee practice focused on straightforward estate planning for parents. Some matters fall outside what we do, such as contested estates, complex trust or business succession structures, cross-border assets, or matters where capacity is in question. Where we cannot assist, we will tell you and, where we can, refer you elsewhere. We are not responsible for the services of any practitioner we refer you to.

7. Information you give us

You are responsible for the accuracy and completeness of the information you give us.

This matters more in estate planning than in most areas of law. Documents are prepared on the basis of what you tell us about your family, your assets and your wishes. If that information is incomplete or wrong (for example, a former spouse not mentioned, a child from another relationship, a property held as joint tenants or a self-managed superannuation fund), the documents may not achieve what you intend, and we are not responsible for that outcome.

Where you give us personal information about other people (children, executors, attorneys, guardians, beneficiaries), you confirm you are entitled to do so. Our Privacy Policy explains how we handle it.

8. Intellectual property

All content on this website, including text, graphics, logos, layout, photography, guides and the design of the site, is owned by or licensed to us and protected by copyright. “The Parent Will” and our logo are our trade marks.

You may view the site, and print or download pages, for your own personal, non-commercial use. You may not:

  • reproduce or distribute our content commercially;
  • use it to train or develop any machine learning or artificial intelligence system;
  • scrape the site by automated means; or
  • use our name or branding in a way suggesting affiliation or endorsement.

9. Third-party links and services

This website uses and links to third-party services, including booking, payment, analytics and email tools, and may link to external websites. These operate under their own terms and privacy policies. We do not control them and are not responsible for them.

10. Website availability and liability

We aim to keep this website available and working, but do not guarantee it will be uninterrupted or error-free. We may modify or suspend any part of it without notice.

Consumer guarantees. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability for breach of a non-excludable guarantee, we limit it to resupplying the relevant service or paying the cost of resupply.

Otherwise, and to the maximum extent permitted by law, we are not liable for loss or damage arising from your use of this website or reliance on its general information.

Our liability for legal services we provide to you is governed by your costs agreement and by the professional standards scheme that applies to us, not by this section.

11. Privacy

How we handle personal information is set out in our Privacy Policy. How we use cookies is set out in our Cookies Policy.

Separately from privacy law, we owe our clients strict duties of confidentiality, and legal professional privilege attaches to communications made for the purpose of giving or obtaining legal advice.

12. Complaints

If you are unhappy with our service, please tell us first at hello@theparentwill.com.au and we will respond promptly.

If we cannot resolve it, you can complain to the Legal Services Commission (Queensland) at lsc.qld.gov.au.

13. Governing law

These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.
